Two thirds of all divorces involve children who are still minors and these children who can potentially grow up in the sole custody of one parent are statistically more likely to divorce themselves one day. Regardless, in American society nearly everyone will be affected by divorce at some point in their life. Like it or not divorce is a very real part of American society and how it is dealt with is an important question.

Even though divorce isn't always avoidable in modern society there is an alternative to vicious litigation in divorce mediation. Divorce mediation, conducted by professionals can streamline the process of determining issues such as custody of children and division of assets. One of the major advantages of divorce mediation is that the both people involved in the divorce will get to decide on what issues they'd like to see resolved.

The divorce mediator is selected by both parties involved in the divorce and the proceedings are completely voluntary. However, for the mediation to work both spouses have to be willing to meet with a mediator that they both trust to be impartial. Trust is paramount and for the mediation to work both sides must trust the mediator. Divorce mediators don't have to hold any special licenses but it is generally wise to check the references of the mediator to ensure that the mediator has the proper experience to effectively mediate the agreements of a divorce. Typically, even though both parties are likely to bring their own legal counsel a mediator will have legal experience; this way the mediator will be able to advise both sides on legal issues.

All costs for the mediation are traditionally split evenly between both spouses. Some mediators will charge a flat fee others will charge an hourly fee. The overall cost of mediation can be expensive when one takes into account the cost of the mediator and each person's own lawyer being present for the mediation to make sure no important rights are waived. However, the advantage of this upfront cost is it mitigates unanticipated legal fees from a protracted and nasty divorce. With the proper divorce mediation both people can iron out final details in a civil way and gain some closure at the unfortunate end of a marriage.
