Almost all of us dream of owning a brand new car at some point of our lives. Thus, many often save every extra penny that they can for that dream car. And when that brand new car does becomes available in the showroom, many would often immediately buy it the moment they saw it.

But what if the new car that you have just bought start conking out while you are on your way home. And then, after that, the car repeatedly breaks down. Then you might want to pursue a lemon law claim to get your money back.

A lemon law claim is essentially a claim against a seller of a vehicle that does not perform according to what he claims it is supposed to. While lemon law claims are more usually used when claiming warranty for new cars that are defective, they can also be used to get compensation for those who bought used cars, though one needs to know the applicable laws with regards to used cars. Also, take note that different states have different applicable lemon laws, so you should be aware of the applicable ones to your case.

Filing a lemon law case is easy, however, winning one might often be far from such. As it is, there are a lot of reasons that car sellers can cite to wiggle their way out of a lemon law claim. One of the most popular of this is that of buyer misuse, which often automatically frees the seller from any lemon responsibility. Another one is that the defect is not substantial in certain driving conditions.

However, whichever reason the seller points out, the costumer can still go after lemon law compensation if he has enough evidences to back of his claims. One of the most important of these documents is the car's repair history, which the court will use to assess whether or not the car in question do fit the description of a lemon. Thus, it would be a good idea if you get the complete repair history of the car you are buying upon purchase, or have a written warranty if you are buying a new car

also, it would be a good idea that you get an independent mechanic to tag along with you in order for him to assess if the car is indeed a worthy buy. Once you have the car, be sure to have it inspected by the mechanic in order to determine any flaws not mentioned by the seller. Again, don't forget to get the repair details from the mechanic in order to compare it with the one given by the seller.
