Know What Makes a Drug Case in Sydney?

The Government’s conservative stance on the ‘war on drugs’ has made it near impossible to implement harm reduction methods of addressing issues in drug use, such as pill testing at music festivals. 1- Cultivation of Drugs:

Section 23 of the Drug Misuse and Trafficking Act 1985 (NSW) makes it an offence to cultivate, supply, or possess a prohibited plant. A prohibited plant is defined as a cannabis plant, or any growing plant of the genus Erythroxylon (cocaine) or of the species Papaver Somniferum, Papaver orientale or Papaver bracteatum (all varieties of opium poppy). Maximum penalties for these offences range from a fine of 2,000 penalty units ($220,000) and/or imprisonment for 10 years, to a fine of 3,500 penalty units ($385,000) and/or imprisonment for 20 years, depending on the amount and type of plant.

2- Importing/Exporting Drugs:

The importing and exporting of drugs in any form is a huge problem in Australia. Division 307 of the Criminal Code 1995 (Cth) outlines import and export drug offences. The penalties depend upon the quantity and type of drugs in question but the maximum penalty in the legislation is a fine of 7500 penalty units ($825,000) and/or life imprisonment. 3- Continuous Supply of Drugs:

If a person supplies a prohibited drug, other than cannabis, on 3 or more separate occasions during any period of 30 consecutive days, for financial or material reward, is guilty of an offence according to section 25A of the Drug Misuse and Trafficking Act 1985 (NSW). The maximum penalty for such an offence is a fine of 3,500 penalty units ($385,000), and/or imprisonment for 20 years.

4- Supply of Illegal Drugs:

A person may give their friends or acquaintances a prohibited drug and not realise the severity of doing so. The supply of a prohibited drug is a serious offence under section 25 of the Drug Misuse and Trafficking Act 1985 (NSW). Severe penalties are imposed for this, with a similar range to the penalties for import/export prohibited drugs, above.
